By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully before completing a transaction.

2. Eligibility & Contract Formation

  • Age Requirement: By purchasing a vehicle from EU Motos, you confirm that you are at least 18 years of age or have explicit legal parental consent.
  • Order Acceptance: Your order represents an offer to purchase. A legally binding contract is only formed when you receive an official “Order Confirmation and Invoice” email from us. We reserve the right to decline or cancel orders due to stock inaccuracies, pricing errors, or shipping restrictions.

3. European Pricing, VAT, and Payment

  • Currency: All transactions and prices displayed on our website are in Euros (€).
  • Payment Methods: We accept secure European payment methods, including credit cards and bank transfers. Bikes will not be dispatched until funds are settled in full.

4. Shipping, Delivery, and Transfer of Risk

  • Territory: We ship exclusively to valid physical addresses within the European Union customs border.
  • Transfer of Risk: In accordance with EU consumer law, the risk of loss or damage to the goods passes to you the moment you (or a third party authorized by you) sign for and take physical possession of the vehicle or package.
  • Inspection upon Delivery: You are required to inspect the vehicle crate or box upon delivery. Any transport damage must be noted directly on the courier’s freight documents before signing and reported to our support team within 48 hours.

5. Product Intended Use & Local Legislation

  • Competition and Off-Road Closed-Course Use: You acknowledge that the Stark VARG and Bonnell electric dirt bikes sold on this platform are high-performance off-road competition vehicles.
  • Public Road Legality: Unless explicitly stated in a specific product listing as a street-legal, homologated variant (e.g., L1e/L3e EU category), these vehicles are not street-legal and cannot be ridden on public European roads.
  • Compliance: It is the buyer’s sole responsibility to ensure compliance with local regional environmental, noise, registration, or licensing laws regarding off-road riding in their specific country or municipality. EU Motos accepts no liability for fines or impoundments.

6. Limitation of Liability

  • Risk of Sport: Motorized off-road riding is an inherently dangerous sport. EU Motos, its directors, and employees shall not be held liable for any personal injury, property damage, or death resulting from the operation, misuse, or racing of vehicles purchased from our store.
  • Technical Information: While we endeavor to keep all power ratings (e.g., Stark VARG 80HP claims, Bonnell battery capacities) accurate to factory specifications, minor deviations may occur based on firmware updates or riding conditions.

7. EU Right of Withdrawal & Guarantees

  • Returns: Your right to cancel your purchase within 14 days is fully outlined in our separate Refunds & Returns Policy.
  • Statutory Warranty: All consumer purchases are backed by the 2-Year European Statutory Warranty covering manufacturing defects present at the time of delivery. This does not cover wear-and-tear parts (tires, chains, sprockets, brake pads) or damage resulting from crashes, water submersion, or unauthorized modifications.

8. Governing Law and Dispute Resolution

  • Jurisdiction: These terms are governed by the laws of the EU member state where our corporate entity is registered [e.g., Germany / The Netherlands / Italy].
  • Online Dispute Resolution (ODR): The European Commission provides an online dispute resolution platform for consumers encountering issues with online purchases. Further information is available through official European Union channels.
